As Advocates for folks dependent on needs-based public benefits, we all experience repeated violations of the basic Constitutional rights of due process. When due process rights are violated within the course of the Medicaid eligibility process, or during the administrative hearing phase, an award of attorney fees and costs against the agency may be appropriate and necessary.

NAELA Fellow Award

In April 2009, Ms. Dudek was bestowed the highest honor of the National Academy of Elder Law Attorneys (NAELA) by being named an NAELA Fellow, a designation for those who concentrate practice in the field of Elder Law and meet strict criteria. Only 76 attorneys hold this title throughout the United States.

Understanding SSDI: How to Get It, Handle Denials or Loss of Benefits, Overpayments, and Coordinate

SSDI is an income benefit paid by the SSA to a disabled worker who qualifies for benefits.  The authors provide a practical and easy to follow set of steps to the appeal of SSDI denials, resolution of overpayment issues, and the practical coordination with other public and private benefits.

Why Plan for the Future

The number of individuals in this country with disabilities has grown significantly in the past decade. Advances in medical treatment and technology have led to increased survival rates and longer life expectancies. Future planning is important in order to secure essential services and financial resources for persons with disabilities, especially after the death of their parents.
